WEkEO GENERAL TERMS AND CONDITIONS

By registering for WEkEO V0 (hereinafter referred to as ‘the Service’), jointly operated on behalf of the European Union by EUMETSAT, ECMWF and Mercator Océan (hereinafter referred to as ‘the Implementing Partners’) you acknowledge and confirm to have understood that the Service, including all associated applications, content and information is subject to the following terms and conditions. Unless otherwise notified, it will be assumed that your continued use of the Service constitutes full acceptance of these General Terms and Conditions.
As long as the Service is being provided for demonstration purposes and remains free of charge (full duration of WEkEO V0), the Implementing Partners - at their sole discretion - reserve the right to discontinue, temporarily or permanently, any means of accessing or utilising the Service without providing advance notice. Any breach of these General Terms and Conditions and any illegal or improper use of the Service will also lead to the immediate exclusion of a registered user from the Service.
Furthermore, please note that the Implementing Partners reserve the right at any time without advance notice to change its operating provider. To facilitate a seamless transition (from WEkEO V0 into V1.0) your account details will be migrated to the new provider and will likely involve a modification to the applicable terms and conditions. For the sake of full transparency, you will be asked to review the updated terms and conditions and provide your consent once more. Where consent is not provided, it will be assumed that you have no intention to continue using the Service. Your account will subsequently be suspended and any content and information stored on it deleted.
2. Copernicus Sentinel Data and Service Information
By using the Service you are able to download and use Copernicus Sentinel Data and Service Information. Please consult and familiarise yourself with the Legal Notice on the use of Copernicus Sentinel Data and Service Information, ensuring that you have understood how and for what purposes Sentinel Data and Service Information may be used and taking note of the European Union’s limited liability.
3. Personal Data
In the course of your registration you will be asked to provide personal data (while some fields are compulsory, others remain optional) including your email address, username, first name, surname, your country of origin, the name of the organisation you are registering on behalf of, your sector of work. These personal data will be processed exclusively to offer you the most appropriate level of service.
Any additional information collected on your user activity which might include your IP address, data downloaded and time spent on the Service will be used only for traffic analysis, monitoring and service optimisation purposes. In the event that this data needs to be shared with the European Union or any third party, it will undergo adequate anonymization. You can prevent collection and use of your data by downloading and installing the applicable browser plug-in.
Should your personal data change or simply be inaccurate, you can correct or delete your data by editing your account profile at any time.
Taking into consideration the high importance attributed to data protection and cybersecurity across the Implementing Partner’s core user community, the Service is and will continue to be hosted in the European Union. In the event that the Service is moved to a new operating provider, the principles of data protection and cybersecurity will not be compromised or significantly impacted to the users’ disadvantage.
4. Uploading of Data, Content and Information
While the Implementing Partners do not claim ownership of any data, content or information uploaded to the Service by its users, it will monitor and screen on-going activity, deleting and/or refusing to accept data, content, information deemed to be in breach of the General Terms and Conditions or otherwise unacceptable or inappropriate, be it for legal or other reasons.
5. Exclusion of Liability
The Implementing Partners and/or the European Union shall bear no liability for any consequences, whether direct or indirect, arising from use of the Service. This includes but is not limited to adaptations carried out by the user to their own equipment or software based on the qualities of the Service. Any and all adaptations/configurations are exercised at your own risk.
You should also be aware that all data, applications, content and information to which the Service provides access is made available ‘as is’. The Implementing Partners and/or the European Union make no warranty or representation, either express or implied, in relation to the satisfactory quality, fitness for purpose, completeness or accuracy of the Service.
The exclusion of liability applies in equal measure to the contents of external websites, services or software hyperlinked from the Service. Please note that a link to another site or service is not an endorsement of that site or service.
5. Privileges and Immunities
Nothing in or relating to these General Terms and Conditions shall be deemed a waiver of EUMETSAT and ECMWF’s privileges and immunities, conferred on them through their respective Protocols on the Privileges and Immunities.
6. Dispute Settlement
Where a dispute arises all possible efforts shall be undertaken to resolve the issue amicably by out-of-court negotiations. In the absence of any agreement, the matter will be referred to the International Chamber of Commerce for arbitration according to the Rules of Conciliation and Arbitration. While proceedings shall be in the English language, the tribunal shall have its seat in Darmstadt, Germany. Any decision made as a result of the arbitration will be considered final and binding and cannot be subject to appeal.
